1. Who we are

This website is operated by Póg Mo Paw, a general partnership established in Ireland, whose partners are Cónall McAteer and Erica O’Shea.

In these terms, “we”, “us” and “our” mean Póg Mo Paw. “You” means the person placing an order.

2. These terms

These terms apply to every order you place through this website. Please read them before ordering. By placing an order you confirm that you accept them.

Nothing in these terms affects your statutory rights as a consumer under Irish or EU law. Where anything here conflicts with those rights, your statutory rights take precedence.

You must be at least 18 years old to place an order.

3. How a contract is formed

Placing an order is an offer to buy. We will send you an email acknowledging that we have received your order, but this does not mean your order has been accepted.

A contract between us comes into existence only when we send you an email confirming that your order has been dispatched, or that work on a made-to-order item has begun.

If we cannot accept your order, we will tell you and refund any payment in full. This may happen if an item is out of stock, if we have identified an error in the price or description, or if we are unable to meet a delivery deadline you have specified.

4. Our products

We describe and photograph our products as accurately as we can. Colours shown on your screen may differ slightly from the actual product, and packaging may vary.

Many of our items are made by hand. Small variations in finish, grain, stitching or shade between individual items are normal and are not defects.

5. Personalised and made-to-order items

Some of our products can be personalised with a dog’s name or other details you supply.

Please check your spelling carefully before you order. We produce personalised items exactly as the details are entered at checkout. We cannot correct spelling, spacing or capitalisation after production has begun, and we are not able to offer a refund or replacement for an item personalised with details you entered incorrectly.

Personalised items cannot be cancelled or returned under the 14-day cooling-off period. Under Irish and EU consumer law, the right of withdrawal does not apply to goods made to your specification or clearly personalised for you. This does not affect your rights if the item arrives faulty, damaged or not as described. See sections 8 and 9.

We reserve the right to decline personalisation requests that are offensive, or that infringe someone else’s trade mark or other rights. If we decline, we will contact you and offer either an amendment or a full refund.

Made-to-order items typically take 2-3 business days to produce before dispatch.

6. Prices and payment

Prices are shown in euro and include VAT where applicable. Delivery charges are shown separately and are added at checkout before you confirm your order.

We take reasonable care to ensure prices are correct. If we discover an error in the price of an item you have ordered, we will contact you before dispatch and give you the option to continue at the correct price or cancel for a full refund.

Payment is taken at the time you place your order and is processed by our payment provider, SumUp. We do not receive or store your full card details. See our Privacy Policy for how your data is handled.

7. Delivery

We deliver around the island of Ireland.

Orders are normally dispatched within 1-3 business days, and delivery usually takes 1-2 business days from dispatch. Delivery costs are €2. These timescales are estimates, not guarantees.

If we have not delivered within 30 days of the contract being formed, or within any longer period we have agreed with you, you may give us notice of a further reasonable period. If we still fail to deliver, you may cancel the order and we will refund you in full.

Responsibility for the goods passes to you when they are delivered to the address you gave us. Please make sure that address is correct and complete; we cannot be responsible for orders lost because of an incorrect address supplied at checkout.

If an order is returned to us as undelivered because nobody was available to accept it, or because the address was incorrect, we will contact you. You may be asked to pay a further delivery charge to have it sent again.

8. Your right to cancel (14-day cooling-off period)

If you are a consumer, you have the right to cancel most orders within 14 days without giving a reason.

The cancellation period ends 14 days from the day on which you, or someone you nominate, receives the goods. Where an order is delivered in several parts, the period runs from the day you receive the last item.

To cancel, tell us clearly before the 14 days are up. You can email us at Pogmopaw@gmail.com, or use the model cancellation form available on our Returns page. Simply sending the goods back without telling us is not enough.

Returning the goods. You must send the goods back to us within 14 days of telling us you are cancelling. You are responsible for the cost of return postage unless the item is faulty or not as described. We recommend using a tracked service, as you remain responsible for the goods until they reach us.

Refunds. We will refund the full price of the goods plus the standard delivery charge you originally paid. If you chose a more expensive delivery option, we refund the standard cost only. We will make the refund using the same payment method you used, within 14 days of receiving the goods back, or of receiving proof that you have sent them, whichever is earlier.

You may handle the goods as you would in a shop. If their value is reduced because you have handled them more than that, we may deduct an amount reflecting the reduction.

Exceptions. The right to cancel does not apply to:

  • goods made to your specification or clearly personalised for you, including any item personalised with a dog’s name;
  • goods that are liable to deteriorate or expire rapidly;
  • sealed goods that are not suitable for return for health protection or hygiene reasons, if they have been unsealed after delivery.

9. Faulty, damaged or incorrect items

Separately from the cooling-off period, you have statutory rights if goods are faulty, not as described, or not fit for purpose. These rights apply to personalised items too.

If something arrives faulty, damaged or incorrect, contact us at Pogmopaw@gmail.com with your order number and, where possible, a photograph. Depending on the circumstances you may be entitled to a repair, a replacement, a price reduction or a refund. Where we agree to a repair or replacement, we will complete it within a reasonable time and without significant inconvenience to you.

We will cover the cost of returning a faulty or incorrect item.

These rights are in addition to, and not replaced by, any goodwill returns policy we offer.

10. Product use and safety

Our products are accessories for pets and are not safety equipment. Please supervise your dog when using them, check regularly for wear, and stop using any item that is damaged or worn.

Follow any care instructions supplied with the product. We are not responsible for damage caused by use other than as intended, or by failure to follow care instructions.

11. Our liability

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for defective products under product liability law.

Where we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of that failure. We are not responsible for loss or damage that is not foreseeable.

We do not supply goods for commercial or business use, and we have no liability for loss of profit, loss of business or business interruption.

12. Events outside our control

We are not liable for delays or failures caused by events outside our reasonable control, including postal or courier disruption, extreme weather, or failure of utilities or communications networks. If such an event occurs we will contact you as soon as possible, and if the delay is substantial you may cancel the affected order for a full refund.

13. Intellectual property

All content on this website, including our logo, product photographs, designs and text, is owned by us or licensed to us and is protected by copyright. You may not reproduce or use it commercially without our written permission. “Póg Mo Paw” is a business name registered in Ireland and is used as a trade mark in connection with our products.

14. Your personal data

We handle your personal data in accordance with our Privacy Policy, which explains what we collect, why, and what rights you have.

15. Complaints and dispute resolution

If something has gone wrong, please contact us first at Pogmopaw@gmail.com and we will do our best to put it right.

If we cannot resolve matters between us, you can seek information or assistance from the Competition and Consumer Protection Commission (ccpc.ie). For cross-border purchases within the EU, the European Consumer Centre Ireland (eccireland.ie) can assist.

16. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the version published on this website when you placed it.

17. General

If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions continue in force.

If we do not insist that you perform any of your obligations, or delay in enforcing our rights, that does not mean we have waived those rights.

These terms are governed by the laws of Ireland, and you may bring proceedings in the Irish courts. If you live elsewhere in the EU, you may also bring proceedings in the courts of the country where you live.
